At Baines Wilson we are very conscious that a commercial dispute can often interfere with running a business in ways which go well beyond the dispute itself - management time is lost, focus is diverted, and ultimately a valuable business relationship may be at risk.
We adopt a flexible and problem-solving approach to commercial disputes, designed to produce practical business solutions (not just a legal “right or wrong” answer). If the approach has to be tough, we will act accordingly. If the situation calls for an urgent injunction, then we will ensure that the necessary application to Court is made at the earliest opportunity.
If conciliation is the name of the game, we have extensive experience of problem-solving techniques, either negotiation, or Alternative Dispute Resolution (including mediation), but always bearing our clients’ business objectives in mind.
In each case we will discuss with you the various available options and the likely costs involved, so that you can reach an informed choice as to the course of action to be adopted, guided by our advice.

We have acted extensively in both the more normal High Court jurisdictions, and the more specialist Courts, such as the Mercantile Courts, the Technology and Construction Courts, or the Patents Court. We also have wide experience of Arbitrations, Mediations, and other non-Court dispute resolution procedures.
Above all, our aim is to find the right form of dispute resolution process for any individual problem, and to work with you in order to try to achieve a solution that avoids turning a dispute into a crisis.
